Please read these Terms & Conditions ("Terms") carefully before using the Fluid Dream mobile application (the "Service") operated by Fluid Dream ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Eligibility and Age Requirement

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. This Service is not intended for or directed at children under the age of 13.

2. In-App Purchases & Subscriptions

The Service may include in-app purchases and may offer subscription plans that provide access to enhanced features ("Subscription").

• Billing: All payments are processed through the Apple App Store, from which you originally downloaded the application. You must provide a valid payment method to the App Store.
• Subscriptions: Subscriptions are billed on a recurring basis (such as monthly or annually), depending on the plan you select. Your Subscription will automatically renew at the end of each billing cycle unless you cancel it.
• Free Trial: We may offer a Subscription with a free trial for a limited period. You will be required to enter your billing information to sign up for the free trial. If you do not cancel before the end of the free trial period, you will be automatically charged the applicable Subscription fee for the plan you have selected.
• Cancellation: You may cancel your Subscription renewal at any time through your Apple ID account settings. You will continue to have access to the Service through the end of your current billing period.
• Fee Changes: We reserve the right to modify the Subscription fees at any time. Any fee change will become effective at the end of the then-current billing cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
• Refunds: Except when required by law, paid Subscription fees are non-refundable. All refund requests are handled by Apple, and you must contact Apple App Store support for any refund inquiries.

3. User-Generated Content

You are able to create and input your own content, such as dream descriptions and journal entries ("User Content").

• Your Ownership: You retain all of your rights to any User Content you create within the Service.
• License to Us: By creating User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, process, and display your User Content solely for the purpose of operating, providing, and improving the Service. This includes processing your text with third-party AI services, as detailed in our Privacy Policy, to provide features like dream analysis.
• Your Responsibility: You are solely responsible for the User Content you create. You represent and warrant that your User Content does not violate the law or the rights of any third party. You agree not to submit any content that is illegal, defamatory, hateful, or infringing on intellectual property rights.
• Our Rights: We are not obligated to monitor User Content. However, we reserve the right to remove any User Content at any time, for any reason, without notice.

4. Intellectual Property

The Service and all its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Fluid Dream and its licensors. This includes, but is not limited to, our logo, visual design, text, graphics, and trademarks. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Feedback and Suggestions

Any feedback, comments, ideas, or suggestions ("Feedback") you provide to us regarding the Service is entirely voluntary. You agree that we are free to use such Feedback as we see fit and without any obligation, compensation, or credit to you. Submitting Feedback grants us perpetual and irrevocable ownership of such Feedback.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Fluid Dream, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
